Any person who has not resided in Georgia for six (6) months but who has been a resident on a United States Army post or military reservation in Georgia for one (1) year immediately preceding the filing, may bring a divorce action in Georgia. This exception would not include a member of the military who has never been stationed in a military facility in Georgia. It should be noted that residing in Georgia pursuant to military orders (presumably less than twelve (12) months) does not prevent a member of the military from electing to become a resident of the State of Georgia (which requires only six (6) months as explained above).
If the filing spouse is a non-resident, Georgia law requires that the non-filing (Defendant) spouse shall have been a resident of the State and County in which the divorce suit is brought for six (6) months prior to filing. In other words, if the filing spouse cannot meet the six (6) months residency requirement, the Superior Court may obtain subject-matter jurisdiction nonetheless if the defendant has been a resident in the State of Georgia and in the county where the divorce suit is filed for six (6) months prior to filing.
